Manulife Website Terms of Use

These Terms of Use (the “Terms”) govern your use of The Manufacturers Life Insurance Company’s (Manulife’s) Canadian customer website(s) (the “Site”). 

BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

Manulife reserves the right to amend the content of the Site and any or all of the products and/or services provided through the Site at any time, with or without notice. Manulife further reserves the right to amend the Terms at any time, with or without notice. Any changes to the Terms will be made available to you through the Site. By accessing or using the Site after the posting of changes to the Terms, you agree to be bound by such terms, as amended.

1. Use of the Site(s)

We grant you a limited, revocable, non-transferable, and non-exclusive right to enter and use the Site. We can terminate this license at any time, with or without any reason.

Manulife authorizes you to use the Site for convenience and for the purpose of transacting business with, or participating in programs with Manulife, where applicable.

As a condition of your use of the Site, you warrant to Manulife that you will not use the Site for any purpose that is unlawful or prohibited by the Terms. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site.

2. Release and Waiver

By using the Site, you acknowledge that you are doing so voluntarily and with the understanding that Manulife and its partners, affiliates, subsidiaries, employees, directors, and agents are not providing you with medical, financial, legal or tax advice.

You understand that any activities, goals, or other information presented to you through the Site are not substitutes for a medical professional’s evaluation, diagnosis, and treatment. You understand that regardless of your physical condition, participating in certain elements of the Site may involve physical exercise or other activities that may involve risk of injuries or aggravation of preexisting injuries, diseases or physical conditions, and such activities may not be appropriate for all persons. You must obtain necessary medical advice about participation on the Site from your personal medical service providers.

You understand that the provisions contained in this Release and Waiver is contractual and not a mere recital, and you have read it fully. You hereby acknowledge that you understand and voluntarily accept it and all other Terms of Use contained herein.

3. Rewards Program

Eligible group benefits members may have the opportunity to earn designated rewards as described within this Site (the “Rewards Program”) by participating in certain activities, all of which may be limited by number, size, time, or other limiting factors (each a “Qualifying Activity”).

For each Qualifying Activity completed, you will receive specified rewards as solely determined by us. We may, in our sole discretion, (i) put a start and end date on any Qualifying Activity; (ii) amend the end date (or eligibility thereof) of any Qualifying Activity; (iii) amend the rewards that can be earned per Qualifying Aactivity at any time; and (iv) cap the number of participants in the Rewards Program. Even if you are eligible, your participation in the Rewards Program, or any component thereof, is not guaranteed.

You agree that your participation in the Rewards Program is purely voluntary, and you may choose to participate or stop participating at any time. We retain the right to terminate and/or disable your access to the Rewards Program at any time for any reason.

If you believe that rewards have been earned but not properly credited, you may be required to submit documentation or other proof that is satisfactory to us. All questions or concerns regarding the crediting of rewards must be made within 90 days of completion of the associated Qualifying Activity.

We reserve the right to correct, modify, or reverse the crediting of rewards that are mistakenly or improperly awarded to you at any time and without notice.

Participation in the Rewards Program is based on trust. Where dishonesty or fraud is reasonably suspected or discovered, any or all of the following actions may be taken: (a) rewards may not be credited or may be revoked; (b) you may be temporarily or permanently banned from participating in the Rewards Program; (c) we may take any other action consistent with our legal rights.

All rewards and other benefits of the Site cease immediately upon suspension or termination of your use of the Site and will not be reinstated. Suspension or termination of your use of the Site will not automatically suspend or terminate your Manulife insurance policy or financial product.

For eligible group benefits members to earn rewards in the form of Aeroplan® points, you must be an Aeroplan member and have an account in good standing, all in accordance with Aeroplan’s Terms and Conditions, and link your Aeroplan account to this Site by following the instructions set out on the Site.

4. Intellectual Property

Unless otherwise indicated in respect of another person’s trademark, we are the owner or licensee of all rights, title, and interest in and to the Site, including any intellectual property rights therein. Intellectual property rights include, without limitation, copyright, patent rights, industrial design rights, trademark rights, and confidential information. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble, or otherwise attempt to derive source code from the Site.

5. Account, Passwords and Security

You agree that the information you provide to Manulife in connection with registering to use the Site and at all other times will be true, accurate, current and complete and will ensure that this information is kept accurate and up to date at all times. You are responsible for ensuring the security and confidentiality of your Manulife ID and any other log-on information.

You agree to:

• Exercise appropriate care when using your Manulife ID and any other log-on information to avoid theft, misappropriation, unauthorized access and unauthorized communication.
• Keep your Manulife ID and password confidential, and not disclose them to anyone.
• Notify us immediately upon learning that your Manulife ID  and password has been disclosed or obtained by anyone else or may be known by anyone else, or that unauthorized use of the Site may be occurring with your Manulife ID  and password.

Your log-on information, including your Manulife ID, password and any applicable biometrics data such as fingerprint and facial identification, will constitute your electronic signature (“E-Signature”) where you are transacting business or accessing the Site. You agree that we may use your E-Signature as a means to authenticate your identity and to accept without any further verification, all instructions provided by you via the Site, including but not limited to contracting with Manulife, renewing or applying for benefits, submitting claims, changing investments, updating your personal information and any other transactions conducted on the Site, as applicable.

You also (a) acknowledge and agree that your E-Signature is the legal equivalent of your hand-written signature; (b) agree to be liable for all uses of your E-Signature; (c) acknowledge that Manulife shall not be required to verify the actual identity or authority of any person that accesses the Application using your E-Signature; and (d) agree to indemnify us from and against any loss caused as a result of or in connection with, any unauthorized use of your E-Signature, or any failure to comply with the above requirements to keep such E-Signature confidential, even if such loss occurs without your approval or knowledge.

You agree to comply with all security requirements established by Manulife from time to time in connection with the use of the Site and not disable or bypass any security features. Unauthorized attempts to circumvent security features, to use the Site for purposes other than its intended purposes, or to obtain, alter, damage, or destroy information or otherwise interfere with the operation of the Site are not permitted, and any evidence of such acts may be disclosed to law enforcement authorities and result in criminal prosecution.

6. Communications by Electronic Means

You consent to engage in electronic communications with Manulife, including but not limited to online and/or electronic mail or by other electronic means at such numbers or addresses you provide to Manulife, and that all contracts, notices, disclosures, and other communications that Manulife provides to you electronically satisfy any legal requirement that such communications be in writing.

Manulife will not be responsible or liable for any loss or damages you may incur if you communicate confidential or other personal information to Manulife online and/or by electronic mail or by other electronic means or if Manulife communicates such information to you by these means at your request or as a reply to a communication sent by you over the same channel. Manulife may verify communications or the source of the communications before it accepts them, but it is not obligated to do so.

7. Privacy

Manulife’s Privacy Policy applies to the use of the Site, and its terms are made a part of these Terms by this reference. To view our Privacy Policy, click here. We shall adhere to applicable laws regarding privacy and the protection of personal information, and shall maintain appropriate administrative, technical, and physical measures to safeguard and secure your personal information. 

8. Disclaimer and Limitation of Liability

We provide the Site as a convenience to you on an “as available” basis and do not guarantee uninterrupted operation. We disclaim all express, implied, and statutory warranties including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement of proprietary and intellectual property rights, and any warranties regarding the security, reliability, accessibility, timeliness and performance of the Site.

We have no obligation to support the Site, or to maintain or update any software or documentation related to the Site.

Information provided within the Site may be lost, not delivered, inaccurate, delayed, intercepted, reviewed, used, or altered by others. We are not liable for any direct or indirect, special, consequential, exemplary or punitive damages or for any losses arising out of your or any person’s use or inability to receive or to use, the information or the Site regardless of the cause of action, including negligence, even if we are advised of, are aware of, or should have been aware of, the possibility of such damages.

We shall not be responsible or liable for any loss or damages you may suffer in connection with the Site, including any loss of access, reduced access, or unauthorized access to the Site, or in connection with your communications to Manulife through the Site and its replies via the same channels with the exception of breaches of privacy, confidentiality or security due to our negligence or breach of applicable law.

You use the Site at your own discretion and risk. We are not liable for any damages to the device or loss of data or information that results from your use of the Site. In no event will we, or our affiliates, agents, licensors, suppliers, officers, directors, employees, contractors or agents are liable to you or any other person for any harm or damages resulting from any use or misuse of the Site however so caused.

You understand that the availability of the Site to you may be governed in part by your employer's contractual arrangements with us, if applicable, and your continuing membership in the plans or policies, which may change from time to time.

Information you obtain through the Site is not intended to be a comprehensive explanation of your benefits. You are to refer to your member booklet(s) for more information or contact your plan administrator to resolve any questions you may have requiring a detailed description of benefits covered under your plan.

We believe that the information included on the Site is accurate when it is made available on the Site. You understand and agree that we cannot, and do not, guarantee nor ensure the accuracy, completeness or authenticity of the Site’s contents, Site’s functionality, or your transmission of any information or instructions to or from the Site. You agree that neither we, nor any of our affiliated companies, nor any other person associated with the creation or use of the Site shall be liable or responsible to any person for any harm, loss or damage whatsoever that may arise in any connection with your use of the Site.

The information provided on the Site may not be available in all regions of Canada or to persons located in jurisdictions outside Canada. The Site is only available in jurisdictions where they may be legally provided. Nothing contained in the Site constitutes an offer or solicitation to anyone in any jurisdiction in which the content or operation of the Site is not permitted by law.

You fully accept all risk and responsibility involved in engaging in the Site. Before taking part in any activities set out in the Site, it is your responsibility to consult with your healthcare professional for a thorough evaluation, review of your present condition, and guidance on what screenings and activities are safe and appropriate for you.

All investments, funds transfers, deposits and the management of your financial affairs shall be your sole and exclusive responsibility. The information on the Site is not intended to provide you with any financial, investment, legal, tax, commercial, deposit, or other advice, and you shall not rely upon the Site for that advice.

9. Indemnity

You agree to indemnify and hold Manulife, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries, and affiliates harmless from any demands, loss, liability, claims or expenses made against Manulife by any person due to or arising out of or in connection with your use of the Site or your breach or violation of any of these Terms.

10. Records

In the absence of valid evidence of inaccuracy in Manulife's records, Manulife's records of your account are conclusive, and you agree to be bound by Manulife’s records. In the event of a discrepancy between the information provided on the Site and Manulife's recordkeeping system, the information on Manulife's recordkeeping system will prevail. You always have the right to correct any inaccuracies in your personal information by contacting Manulife’s Canadian Privacy Officer.

11. Termination, Suspension, or Inability to Access

Manulife reserves the right, in its sole discretion, to terminate your access to the Site or any portion thereof at any time, without notice. Manulife reserves the right to terminate any or all of the services provided in connection with the Site at any time without notice. Manulife will have no liability for any damage that may arise as a result of such termination.

Any or all of the services available to you through the Site may periodically be unavailable to you in order to allow for maintenance, updates, or other reasonable causes, including causes beyond Manulife's control.

You may, as an alternative to utilizing the Site, contact Manulife directly online, by telephone or mail, as appropriate, during normal weekday business hours or at any other time these services are made available.

12. Governing Law

The Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law.
